Can substance abuse treatment facilities release information to authorities?
I have a friend wants to get help with a substance abuse problem that she has. She has 4 kids, 3 of which she has lost custody. She wants to attend meetings to get help. However, she is unsure if she should reveal that she has kids, for fear of someone telling social services and thus taking her other kid away. What kind of privacy act is in place for organizations such as NA and AA?

First of all it all depends on the state you live in but the rule is pretty much standard that if she has a child and is using and she goes to AA or NA meetings or some kind of methadone clinic or rehab facility and speaks to staff or a counselor there, if that person thinks that the child is in danger or not properly cared for that they can disclose this info to Social Services or the police. This is not considered a violation of the confidentiality law because children in danger are victims and can’t speak for them selves. If she is serious I totally recommend she go for the treatment but have her kids stay with a friend or her mom or dad or someone else. This way the child isn’t in danger while she is getting her help and no one will be able to take it away. I have lots of info on this, if you need anything please email. It is unfortunate but Social Services will look more at the fact that she has lost her other children and may not be fair in assessing her ability to care for her child. This happens to be a very tough for people who want help but don’t want to lose their children. Social Services and Children and Youth are not always fair.. But to be fair there are many people that don’t succeed in getting better so they are basing it off the persons past and the success rate of other addicts..Good luck.
